These Terms & Conditions apply to all clients engaging Mint Landscapes for garden maintenance, landscaping, irrigation services, or any other works performed. By accepting a quote, making a booking, or continuing with service, you agree to these terms.

1. Ongoing Maintenance Clients

1.1 Visit Frequency

  • Maintenance visits are scheduled every 2 or 4 weeks as per your service agreement.
  • You will receive a reminder text the day before each scheduled visit.

1.2 Changing or Skipping Visits

  • Visits may be rescheduled within the same week with at least 2 working days’ notice, subject to availability.
  • Visits may be skipped with at least 2 working days’ notice. If notice is not provided, the visit may still be charged.
  • Skipped visits resulting in excessive overgrowth may incur an Overgrown Fee starting at $35 + GST, depending on property size.

1.3 Green Waste Removal

  • Green waste will be removed unless stated otherwise in your invoice.
  • If your green bin is full or unavailable, a fee of $40 + GST per bag (measured in 1/4 increments) will apply, unless a different amount has been agreed upon in advance or removal is already factored into the quoted cost.

1.4 Reticulation Repairs (Maintenance Clients)

  • Time on site and parts are charged separately.
  • Minor repairs and parts up to $50 + GST are pre-approved.
  • Labour is pre-approved for up to 60 minutes and charged at $115 + GST/hour, in 15-minute increments.
  • Major repairs will be quoted before proceeding.

1.5 Lawn & Garden Treatments

  • If pre-approved, your service includes up to 4 treatments per year, capped at $200 inc. GST per application.
  • Treatments may include fertiliser, wetting agents, or pest control.

1.6 Weed Control & Spot Spraying

  • Glyphosate is used for weed control in garden beds and paved areas.
  • If you do not want glyphosate used, please notify us in writing. Alternatives may incur additional labour charges.

1.7 Extra Work Requests

  • Please send requests at least 2 days prior to your visit.
  • Minor tasks may be included; larger tasks or those requiring materials will be quoted.

2. Landscaping Projects

2.1 Scheduling & Timeframes

  • Work typically begins between 7:00am and 8:00am.
  • Multi-day projects may not be scheduled on consecutive days due to weather, crew availability, or material delays.

2.2 Plant & Material Changes

  • Plant selections and material changes must be finalised at least 2 weeks before the start date.
  • If specified items are unavailable, suitable substitutions will be made. Price variations will apply accordingly.

2.3 Mulching & Soil Levels

  • Mulch is installed over existing soil unless otherwise agreed.
  • Soil removal or excavation is not included unless specified and quoted separately.

2.4 Variations

  • Variations up to $2,000 + GST or 10% above the final quoted figure, whichever is higher, are pre-approved.
  • Variations above this amount require client approval before proceeding.
  • Changes due to garden conditions or scope outside the quote validity period may incur extra charges.

2.5 Quote Validity & Acceptance

  • Quotes are valid for 14 days from issue.
  • Acceptance beyond 14 days may result in price adjustments.

2.6 Payment Terms

  • A deposit is required to confirm booking.
  • Final balance is due within 7 days of completion.
  • Progress payments are only accepted if pre-agreed.

2.7 Clean-Up & Waste

  • Site will be left clean.
  • Waste removal is included only if specified in the quote.

2.8 Post-Installation Support

  • Up to 3 follow-up visits will be provided over 6 weeks to monitor irrigation and plant health.

2.9 Irrigation Setup

  • Existing irrigation systems will be programmed, or a manual watering schedule will be provided.

3. Reticulation Repairs & Installations

3.1 Scope & Responsibility

  • Clients are responsible for marking underground services.
  • We are not liable for damage to unmarked or undisclosed underground services.

3.2 Urgent Repairs & Referrals

  • For urgent issues, we may engage a preferred contractor and pass on the invoice.
  • You may choose to engage your own contractor if preferred.
  • All time spent on diagnosis and completed work will be invoiced regardless of resolution.

4. General Terms

4.1 Site Access & Client Responsibilities

  • Ensure site access from 7:00am on service days.
  • Remove items obstructing work areas (e.g., vehicles, toys, dog waste).
  • Protect or remove fragile fixtures and personal belongings.
  • Inform us in writing if specific plants or features must not be touched.

4.2 Reticulation Adjustments

  • We may adjust irrigation settings to support plant health, in line with Water Corp guidelines.
  • Notify us in writing if you prefer to opt out.

4.3 Ownership of Materials

  • All materials remain the property of Mint Landscapes until full payment is received.

4.4 Liability for Plant & Lawn Health

  • We are not liable for plant or lawn decline due to weather, pests, or irrigation issues outside our control.

4.5 Payment Terms

  • Maintenance: Invoiced after each visit, due in 7 days.
  • Landscaping: Deposit required; balance due in 7 days post-completion.
  • Late payment may result in service suspension, admin fees, or debt recovery. Recovery costs will be passed on to the client.

4.6 Cancellation Policy

  • Maintenance: 10 working days’ notice.
  • Landscaping: 14 working days’ notice before start date. Late notice may forfeit deposit.

4.7 Missed Access

  • If we cannot access the site, fees may apply to cover lost time.

4.8 Reminder Notifications

  • You will receive a reminder text the day before each scheduled service. Let us know if you’d like to update your contact number.

4.9 Accuracy of Information

  • Final invoices may be adjusted if quote information is found to be inaccurate or incomplete.

4.10 Force Majeure

  • We are not liable for delays or non-performance due to events beyond our control (e.g., weather, shortages, strikes).

4.11 Photo Use & Marketing

  • We may take photos for quality assurance and marketing. If you do not wish your property to be photographed, please advise us in writing prior to commencement of work.
